An Overview of Domestic Violence in Ohio

A recent study estimates that roughly 45 million children will be exposed to some variety of domestic violence prior to becoming adults. While approximately 85% of domestic violence claims are filed by women, Ohio has a relatively average number of reports, totaling at 51.9% overall.

In accordance with Section 2919.25 of the Ohio Law and Administrative Rules, it is considered a violation of the law to purposefully harm any member of your household. Several kinds of behavior, per the Ohio Revised Code (ORC), are considered acts of domestic violence. Here are some examples:

  • Abusing a child. Both ORC §§ 3113.31(A)(1) and 2151.031(D) have determined that any action that either potentially or actually causes any harm to a child within your household is an act of domestic abuse. This includes harming their physical, mental, and emotional welfare through verbal, physical, emotional, sexual, and/or psychological abuse. It also includes any act of neglect.
  • Causing any bodily injuries. In accordance with ORC § 3113.31(A)(1), both attempted violence and reckless actions leading to the bodily harm of another member of your household are considered acts of domestic violence.
  • Sexually harming other individuals. Based on ORC § 2950.01(A), causing and/or threatening sexual harm to a member of your household can be considered an act of domestic violence. This can include sexual assault, sexual battery, rape, voyeurism, using minors to produce explicit materials, and compelling prostitution.
  • Stalking and/or trespassing. Aggravated trespassing and/or stalking are both considered violations of ORC § 3113.31(A)(1), and they can lead to you being charged with domestic violence. The law considers safety and personal space to be basic human rights, and these kinds of actions are viewed as being in violation of those rights.
  • Threatening harm to others. According to ORC § 3113.31(A)(1), it is not only an act of domestic violence to physically harm someone, but it is also illegal to threaten any kind of violence against another individual. Should you be accused of threatening imminent harm to someone else, causing them to fear for their safety, you can legally be charged with domestic violence, even if you did not physically harm them in any way.

Hire a Domestic Violence Defense Lawyer in Ohio

There are many benefits of hiring a domestic violence defense lawyer. Beyond their knowledge of Ohio’s domestic violence defense laws, your lawyer can build and deliver a compelling defense, advocating on your behalf and pursuing your desired outcome.

For misdemeanor cases, you may find yourself spending time at the Painesville Municipal Court. Felony cases, however, are often carried out at the Lake County Court of Common Pleas, General Division. Regardless of where your case is handled, a Painesville domestic violence defense attorney may be exactly what you and your case need to protect your reputation and future.

Your Safety Matters, Too

Be sure to tell your lawyer and local authorities if you feel that you are in danger.
