Willoughby Work Injury Lawyer

Filing a workers compensation claim in Cleveland, Ohio

Work Injury Attorney in Willoughby, OH

At Lallo & Feldman, we have been protecting the rights of injured workers in Cleveland, Lake County, Ashtabula and throughout the region since 1979. Being a certified specialist in workers’ compensation, we have a complete knowledge of the Ohio BWC system, and we use that knowledge to secure the benefits our injured clients deserve.

Maximizing The Chances Of Success

Once you suffer an injury on the job or you begin to feel the symptoms of an occupational disease, there are a number of steps that must be taken in order to set the workers’ compensation process in motion. Our Cleveland lawyers will make sure you understand the entire process when you visit our office, but the following is a general overview of the steps:

  • Report the injury to your employer: Claims can be won and lost based on whether the worker properly notified his or her employer of the injury. Make sure to tell the employer that you got hurt on the job, clearly describe how you were injured and be sure to describe all body parts that are in pain, no matter how trivial they may seem.
  • See a doctor: Find a doctor who treats workers’ compensation patients. Such doctors know how to properly document injuries for legal purposes. Our attorneys can assist with this.
  • File a First Report of Injury (FROI): A FROI must be filed with the Ohio Bureau of Workers’ Compensation (BWC). The FROI can be filed by you, your employer or your doctor. The BWC will send you an identification card and claim number. Continue seeing your doctor while the BWC starts processing the claim.
  • Cooperate with your employer: Certain employers have the right to request that injured employees sign a medical release or submit to a medical exam. Also, if you request certain services, such as an MRI, the employer may have you examined by another doctor first. Failure to sign the release or submit to an exam can lead to a suspension of the claim.

By Your Side Through Each Step Of The Process

Lallo & Feldman attorneys help clients in Cleveland and the surrounding areas do everything from filing the initial workers’ comp claim to attending hearings to filing any necessary appeals. We have extensive experience with the BWC and the Industrial Commission of Ohio. You can rely on us to guide your claim as it moves through the system and to pursue all of the medical benefits and lost time payments you need.

What Benefits Can I Receive For My Workplace Injury?

If you were injured at work or you are suffering from an illness caused by a dangerous work environment, your workers’ compensation claim can include a variety of benefits, such as payment for the following:

  • Medical costs
  • Death or survivor benefits
  • Scheduled loss awards for amputations or loss of use
  • Lost wages
  • Working and/or nonworking wage loss
  • Temporary total disability
  • Permanent partial disability
  • Lump sum settlement
  • Permanent total disability
  • Vocational Rehabilitation
  • Safety violations
  • Intentional torts

It is important to note that these are just a few of the potential benefits. Each injury and each claim is different. For example, if you have lost a limb in a work accident, our attorneys may also pursue further compensation. The laws are changing at a rapid pace. Such as, an employer can require you to return to a light duty job which could create an adverse effect on your benefits. You must speak with an attorney for the proper advice. Your employer has a lawyer, so should you.
